Can I stop foreclosure in Miami if I’ve already received a sale notice?

Often, yes—until the auction happens. Options include:

  • Chapter 13 filed before the sale (automatic stay stops the auction).
  • A motion to cancel/postpone the sale for lender errors, active loss-mitigation, or new agreements.
  • Reinstatement or payoff before the sale.
    After the auction, the window narrows fast. Act before the sale date on the notice.
Is bankruptcy my only option to keep my home?

No. Other paths include:

  • Loan modification or a repayment/forbearance plan.
  • Reinstatement (catching up the arrears in a lump sum).
  • Defense in court (challenging standing, accounting, fees, or notice errors).
    Bankruptcy is powerful when time is short or arrears are large, but it’s not the only tool.
How fast do I have to act after getting a Lis Pendens?

Once you’re served with the summons and complaint, the clock starts: 20 days to respond in court. Use that time to file your defenses, start loss-mitigation, or prepare a Chapter 13 if needed. Waiting past 20 days risks a default judgment and a faster sale.

Can you help with second mortgage foreclosure?

Yes. Second liens can foreclose in Miami. Solutions may include:
